Lasting Power of Attorney
An assessment may consider whether a person understands the nature and scope of the authority being granted, the role of the proposed attorney or attorneys, the decisions covered and the reasonably foreseeable consequences.
Managing property and financial affairs
Capacity must be considered in relation to the actual decisions and level of complexity involved. The assessment may examine whether the person can understand, retain, use or weigh relevant information and communicate their decision.
Assessment arrangements
Assessments may take place online where appropriate or in the person’s home or care home. Relevant records and background information are reviewed. The individual should receive practicable support to participate in the decision-making process.
